Privacy Policy

1. Who we are

This policy applies to mountainpeakmktg.com and to the marketing services we provide. In privacy law terms, Mountain Peak Marketing is the "controller" of the personal information described here — we decide what is collected and why.

2. Information we collect

Information you give us

• Contact details — your name, email address, phone number, and business name when you fill in a form, request a strategy call, or email us.
• Your website address — when you use the audit tool on our homepage.
• Project information — goals, budget ranges, current marketing setup, and anything else you tell us in a brief, questionnaire, or conversation.
• Anything you send us — files, logins you choose to share for a project, and the content of your messages.

Information collected automatically

• Device and usage data — IP address, browser type, operating system, referring page, the pages you view, and how long you spend on them.
• Cookies and similar technologies — see section 5.
• Approximate location — inferred from your IP address, usually accurate to the city.

Information from other sources

• Advertising and analytics platforms — aggregated performance data from Google and Meta about how people found and interacted with our ads.
• Publicly available business information — for example a company's public website, listings, or search rankings when we prepare a proposal.

3. The free website audit tool

Our homepage offers a tool that audits a website's speed and technical SEO. Because it involves a third party, it deserves its own explanation.

• The URL you enter is sent to Google. The audit runs on Google's PageSpeed Insights API. Google receives the web address you submit and returns the results. Google's handling of that request is governed by Google's Privacy Policy.
• Your score is shown without an email. You can run the audit and see your score and headline findings without giving us anything.
• The full report requires an email address. If you ask for the complete breakdown, we store the email address you provide together with the site you audited and the results, so we can send you the report and follow up about our services.
• Only audit sites you're entitled to. Please only submit a website you own or are authorized to test.

If you give us your email for a report and later change your mind, use the unsubscribe link in any message or email us and we will delete the record.

4. How we use your information

• To respond to you — answering enquiries, booking calls, preparing proposals and audit reports.
• To provide our services — running campaigns, building sites, and reporting on results.
• To improve the site — understanding which pages are useful and where people get stuck.
• To market our services — sending emails about what we do, and showing ads on platforms like Google and Meta. You can opt out of marketing email at any time.
• To meet legal and accounting obligations — invoicing, tax records, and responding to lawful requests.
• To protect the site — detecting spam, fraud, and abuse of our forms and tools.

We do not use your information to make automated decisions that produce legal or similarly significant effects about you.

5. Cookies and tracking

Cookies are small files stored by your browser. We and our providers use them for a few distinct purposes:

• Necessary — keeping the site working, remembering form state, and security. These can't be switched off.
• Analytics — Google Analytics, to understand traffic and which pages perform.
• Advertising — Google Ads and the Meta pixel, so we can measure ad performance and show relevant ads to people who have visited us. [[Confirm which of these are actually installed and remove any that aren't.]]

You can clear or block cookies in your browser settings, though parts of the site may stop working properly. You can opt out of Google Analytics specifically with Google's browser add-on, and manage ad personalization in your Google Ad Center.

6. Who we share information with

We share information only where it's needed to run our business, and only with parties who are obligated to protect it. Those categories are:

• Hosting and website providers — the companies that keep this site online.
• Analytics and advertising platforms — Google and Meta, as described above.
• Email and CRM providers — the tools we use to send reports and manage enquiries.
• Payment and accounting providers — for invoicing clients.
• Professional advisors — lawyers and accountants, where necessary.
• Authorities — where we're legally required to, or to protect our rights and the safety of others.
• A buyer or successor — if the business is sold or merged, information may transfer as part of that transaction.

7. We do not sell your information

We do not sell personal information for money, and we do not share it for cross-context behavioral advertising in a way that would require an opt-out under Colorado or California law — with one nuance worth stating plainly: advertising cookies from Google and Meta can qualify as "sharing" or a "sale" under some state definitions, even though no money changes hands. If you'd rather that didn't happen, follow the opt-out steps in section 9 and we'll honor it.

8. Your privacy rights

If you live in Colorado, the Colorado Privacy Act gives you the following rights. If you live in California, Virginia, Connecticut, Utah, or another state with a comparable law, you have similar rights and we apply the same process to everyone who asks.

• Access — ask whether we hold personal information about you and get a copy.
• Correction — ask us to fix information that's wrong.
• Deletion — ask us to delete information we hold about you.
• Portability — get your data in a portable, machine-readable format.
• Opt out — of targeted advertising, of any sale of personal data, and of profiling with significant effects.

To exercise any of these, email jonpaul@mountainpeakmktg.com with "Privacy request" in the subject. We'll respond within 45 days and may ask you to verify your identity first. There's no charge for a reasonable request, and asking will never affect the price or quality of anything we do for you.

If we say no

You have the right to appeal. Reply to our decision within 30 days and we'll review it and respond in writing within 45 days, explaining our reasoning. If you're still not satisfied, you can contact the Colorado Attorney General's office.

9. Opt-out signals

We honor universal opt-out mechanisms, including Global Privacy Control. If your browser or extension sends a GPC signal, we treat it as a request to opt out of targeted advertising and any sale of personal data from that browser. You can learn more at globalprivacycontrol.org.

To stop marketing email, use the unsubscribe link in any message or email us directly. We'll still send you operational messages about work in progress if you're a client.

10. How long we keep information

We keep information only as long as we need it for the purpose it was collected:

• Enquiries that don't become clients — up to 24 months, then deleted.
• Audit tool submissions — up to 24 months.
• Client records — for the length of the engagement plus seven years, to meet contractual, tax, and accounting requirements.
• Analytics data — per the retention settings in the platform, typically 14 months.

11. Security

We use reasonable safeguards to protect the information we hold, including encrypted connections, access controls, and reputable service providers. No method of transmission or storage is completely secure, so we can't guarantee absolute security. If a breach affects your personal information, we'll notify you and any regulator as required by law.

12. Children's privacy

This site is intended for business owners and is not directed to children. We don't knowingly collect personal information from anyone under 16. If you believe a child has given us information, contact us and we'll delete it.

13. Third-party links

Our site links to other websites, including client work we're proud of and tools we recommend. We don't control those sites and aren't responsible for their privacy practices. Read their policies before sharing anything with them.

14. Changes to this policy

We'll update this page when our practices change. The "last updated" date at the top always reflects the current version. If a change materially affects how we handle your information, we'll give you notice by email or a notice on the site before it takes effect.
